On The Establishment Of The Crime Of Assaulting Police

Police State has armed with coercion executive power; its essence is the state of social management and control tools and the purpose of the act of the police is to maintain a certain social order. None of contemporary states can exist and develop without police, nor can citizen’s legitimate rights and interests, social order and national security be guaranteed. The implementation of police’s duty, in fact, means the state performs its functions. It represents national authorities. However, the continual high incidence of assaulting a police officer behavior seriously damages the authority of police, which also does much harm to national law enforcement. Undoubtedly, this absolutely results from some social objective reasons and also the subjective reasons of the police itself. But the lag in the regulation of the Criminal Law of assaulting a police officer matters most. Therefore, this thesis has explored that the Criminal Law should be established in the argument of assaulting police from the perspective of necessity and feasibility. What’s more, based on the legislative experiences both at home and abroad, this thesis also tries to define the crime of assaulting police, probe the subjective and objective aspects, criminal purposes and motivation and punishments of the crime of harassing police, which could have a great influence on protecting national legal authority, ensuring police executing public affairs, maintaining social stability and safeguarding the safety of the masses.
