The Study On Rural Poverty Alleviation Law Problem In Hei Longjiang Province

The state attaches great importance to poverty alleviation since the 18th National Congress of the Communist Party of China. When he participated the second session of the 12th NPC Delegation of Guizhou, President Xi Jinping proposed that local government should implement precise measures to alleviate poverty and aim at the right target and also take different measures and policies. The government should not handle several tasks at a time and blast a flea with a hand grenade, because it will cause the waste of money, but the effect is invisible. He stressed that accurate poverty alleviation meant that we might implement refined management of poverty targets, deploy the poverty alleviation resources precisely and support the poverty alleviation target precisely. The local governments need to merge poverty alleviation resources to make better use of them and take targeted measures to ensure that assistance reaches poverty-stricken villages and households. This paper attempts to study on the development policy of rural poverty alleviation in Heilongjiang Province from a legal perspective and aims to alleviate rural poverty problems in Heilongjiang Province.The whole thesis can be divided into four parts. Part I:Introduction. Part Ⅱ:Status of Poverty in Heilongjiang Province and effectiveness of rural poverty reduction measures and Heilongjiang Province in-depth discussion. This part introduces the theory of rural poverty reduction which is the basis of the following practice in rural poverty alleviation. It also discusses the evolution and development of rural poverty reduction policies, including the type of rural poverty reduction policies, poverty alleviation and development phase of work experience and our system of rural poverty reduction policies ultimately formed. Part Ⅲ:This part analyzes and discusses the problems and causes of rural poverty in Heilongjiang Province from the legal perspective. PART Ⅳ:In this part, the thesis thinks about the improvement of rural poverty alleviation and legal systems in Heilongjiang Province, and proposes appropriate legal measures. The author of this paper thinks that from the perspective of rule of law and the farmers’ rights and interests, the local governments should accelerate the improvement of regulations in Heilongjiang Province on rural poverty alleviation in order to provide a powerful legal guarantee to win the battle of deficient assault fortified positions. The perfection of regulation needs to protect the development work of the rural poverty alleviation in an orderly way, achieving accurate poverty alleviation and the legal system which is based on accurate poverty alleviation. In order to promote the economic and social development in poor areas and poverty-stricken counties effectively, to help poverty village out of poor households from the direction of the legal binding, to avoid resolutely the phenomenon of "fake out of poverty", "out of poverty" and engage in "digital poverty" on the legal system design. Human rights is a basic constitutional right. Everyone shall enjoy the right to develop. To fully reflect and protect the basic principles, the Constitution gives everyone the right to develop in the process of poverty alleviation by using proper strategies to find out the reasons of poverty, so that every poor household equally enjoys the right to develop. The government should show the force of the legal system in the aspect of the integration of resources and funds and integrate the resources and funds which related to poverty areas and poverty people with the rigid constraints of the law. The government also needs to avoid the shuffle between departments because of the inadequate force of the files and notices, which causes out of reach the effect of funds integration. The main point of this paper is to find out an effective way to promote the rural poverty alleviation work and win the battle of getting rid of poverty in Heilongjiang Province through the study of the perfection of the regulations in Heilongjiang Province and strengthening law enforcement and law popularization.
