Hint of Jiangsu "4.22" traffic accident is that,on the road driving after drug use behavior have harmful to the society,so it should be stipulated in the crime of dangerous driving as a constitutive requirements behavior.However,One of article 133 of the specific provisions of criminal law in our country has not stipulated the poison driving behavior can be punished, that is for the improvement of the legislation and judicial practice in our country to respond and the composition of punishment law theory have a positive role in promoting。So we should modify one of article 133 of the criminal law in our country, will poison driving behavior regulation for dangerous driving sin,in order to achieve further in the field of criminal law in our country.This paper based on the "4.22" traffic accident in jiangsu province as an example, discusses the crime of dangerous driving. The full text is divided into four parts: The first part lead to the dangerous driving sin through the case; The second part of the legislation present situation has carried on the review of the crime of dangerous driving; The third part on the basis of above discussion puts forward the thinking of dangerous driving crime legislation—Drug driving into the penalty;The fourth part is combined with the new "criminal law amendment(nine) analyses the dangerous driving crime, the criminal law amendment(nine)" added two kinds of dangerous driving behavior, but not including poison driving situations, this is I think one big regret..
