On The Change Of Property Right Caused By The Legal Document Of The Court Of The Court

The changes of property right have its legal reasons. There are mainly two kinds of rules adopted by countries in the world:legal action and nonlegal action on one hand,scholars in law have done a lot of research and analysis.On legal action that causes change of property right.And these research and analysis have formed complete theories.On the other hand,research on nonlegal action that causes change of property right is so much little.There are so many property right change caused by legal documents in the practice.However,the law is not so clear that it takes much trouble in the administration of justice.Scholars also have many different oponions.The most prominent problem is that “legal instruments ”in law Article 28 th include what kinds of legal documents. At the same time, the law in practice also causes many adverse effects, such as the risk caused by the separation of real proprietor and presentational proprietor. On the base of demonstration on legality,rationality and legal basis of property right changes caused by effective legal documents,I analyses 28 th problems in the process of legislation and judicial practice. And then,I measures to troubles in practice and research.Also I try to analgse relief way to balance related conflicts.
