Concerning The Improvement Of The System Of Public Prosecution The Files In China

Establishment of prosecution dossier transferring system is of great significance to prevent the judge prognosis and further to promote the establishment of judicial justice. However, when we positively acknowledge the important function of this system, in the mean time, its inherent deficiency must be recognized seriously.Based on this, this thesis studies and presents the well-established theoretical foundation and detailed conceptions of our national prosecution dossier transferring system in order to contribute to the theoretical researches and judicial practices. This thesis consists of four parts:The first chapter describes the theoretical interpretation of the prosecution dossier transferring system(PDTS). Contents including the definition, categorization and functions of the PDTS will be discussed.The second chapter is to introduce the PDTS of foreign countries. The differences of those compared to our national one will be analyzed and discussed in order to learn and use for reference the successful experiences of advanced countries’ legislative and judicial practices, through which seeking an effective way to improve the PDTS of our country.The third chapter demonstrates the advance on our national PDTS as well as its current judicial status. The historical development, present judicial and practice situations of PDTS in our country are mainly described. In the mean time, the root causes of the existing defects of the present PDTS are discussed in depth.The fourth chapter demonstrates the innovations of the PDTS in our country. Firstly, the basic concept of PDTS in our country is introduced. Then, the present PDTS is reconstructed from the aspect of developing mode. At last, the specific supporting measures on improving our current national PDTS are presented.
