Real estate initiative registration is the most important part of the real estate registration system in our country. But what is the real meaning of real estate initiative registration? Which right can apply for the real estate initiative registration? And what differences it has of the types are used for initial registration procedure? These are all the problems need to be solved. As the research object in this postgraduate thesis, theory and practice problems faced in the process of real estate initiative registration will take into specific discussion.The first part of this thesis introduces the basic theories in initial registration regime, which include the conception of initial registration, the comparison to other legal concepts, and the basic value of the initial registration system. Among these, the most significant and controversial issue is the meaning of the conception, which concerns the discussion of the regime as a whole. It is noticeable that the attitude of legislators on this issue is still in vague, because of the undistributed expressions in different regulations. As to the theories in academic community, one can see the same disaccord as well. For these reasons, clarifying the connotation and denotation of the concept is facing enormous difficulties. In this article, one can see the detailed analysis and clarification on related issues. Basically, the main argument reveals that the initial registration indicates the original registration process for ownership of real estates and the state-owned land employment.Secondly, the author discussed scope of application of different types of real estate’s initial registration which is the core part and main body of the thesis. On the basis of clarifying the meaning of the initial registration, the thesis summarized and analyzed in different chapters the applicable procedures of different types of right and relevant issues. In chapter two, the initial registration of land rights was discussed including the initial registration of ownership and usufruct of the land. In chapter three, the author probed the initial registration of ownership of houses, including the initial registration of ownership of house within state-owned land and that of collective land. In terms of house which belongs to state-owned land, the author discussed the registration applicant, registration agency and application materials then focused on the registration of building differentiation ownership of proprietors in our country. However, for houses which belong to collective land, the key lies in special procedures of initial registration.
