Research On Regulation Of Works Dissemination In The Cloud Storage Environment

Internet has led to significant changes in information communication and has a profound impact on human society. The way to exchange and dissemination information has been change from the traditional print media to the digital network. If the early stage of the people on the Internet have not affected by the network that much, such as David Berg said: "the network does not affect the online crowd(only a small part of the world’s population). If you don’t love the Internet system, you can turn off the modem." However, when the Internet became popular and it influence both political and economic, social and cultural life of the party from the fundamental aspects, no isolation switch can make us not affected by the internet. With the growing popularity of the Internet, more and more people are used to obtain more information through the network, and also share information through the network.Especially in the cloud storage environment, the user is not required to the relevant information in the actual material carrier but to uploaded to the cloud storage environment. The user of cloud storage environment achieve the appreciation of the works by online browsing, disseminate the works by online copying. These two kinds of behaviors are free and universal, and can not be regulated by the relevant contents of the current copyright law. In order to realize the interests of the copyright owner, to find a new mode of operation to adjust the current situation is necessary, this paper discusses the new mode of operation.The paper is written in a logical order by proposed the question, analysis the problem, and solve the problem. In the first chapter to defined the works using behavior classification as well as specific provisions, the works using in the cloud storage space is mainly consumptive use and spread. And by analysising the technology which support the works using behavior, find out the behavior is difficult to be regulated by the current right of reproduction and right to network dissemination of information. Therefore, a new mode to regulate such behavior is needed to make sure author achieve the exclusive interests.The second chapter discuss how the "access control" mode regulate the the works using behavior in cloud storage environment. From the practical needs, as well as the copyright related theory, the International Convention and the relevant laws and regulations of the country to define the necessity, urgency and rationality of the model. And demonstrate the validity of the model from the concrete operation method. The third chapter analyzes the insufficiency of the "contact control" mode, and puts forward the relevant exceptions to prevent the author from controlling the market and balance the exclusive interests of author and the public interest. The growing popularity of network technology in the trend, the "access control" model will be the basis of the sublimation to the exclusive rights to the author-- "access right" to adapt to the future society entered the era of communication carriers. I believe that with the continuous progress of science and technology, in the near future, regardless of whether it is truly establish access right, application of copyright law in network environment will become the focus of attention.
