The Study Of Law Protection Of The Security Of Our Citizen’s Information

Personal information is an important tool for self-identification apart from others, which is of great importance to the meaning of our personal life. However, personal information leakage events happen from time to time around us, which bring great trouble to our lives such as tons of spam messages, constant harassing phone calls and puzzling door-to-door service, disturbing our normal life and sometimes even endangering our personal safety. Nevertheless, the legislation of personal information is only limited to some scattered rules and regulations so far while only the new criminal law has involved to protect related rights. The personal information security system is far from established. This paper attempts to discuss the system of law of personal information rights from several aspects such as the concept of personal information rights, current protective and violated situations, etc.Firstly, the paper discussed the background of personal information rights, then summarized an overview to the relevant research and legislative status at home and abroad in order to put forward some suggestions to improving jurisprudence in our country.Secondly, taken the important value of personal information protection as the entry point, further emphasize the necessity of defining personal information rights. Meanwhile, from the comparison and contrast of portrait, name and privacy right, clarify the boundaries of personal information rights and define it.Thirdly, followed by analyzing the current aggrieved situation of personal information rights and probing into the causes of the current problems, four main reasons of violating personal information rights has been concluded which are legal institution, government, enterprise and individual.The innovation point of thesis is that the author presenting its own ideas,not like traditional p ersonal information security academic articles,whcih merely call for how to solve the problem b y enacting a law,but from the piont of the enterprises and individuals.First of all, it pointed out t he main reason of current leakage of personal information is that many electronic commerce enter prises do not have a sound internal management mechanism,which leads to the leakage of persona l information as the lack of protection of the enterprise.Then, further noted the cause of the problem is that companies do not have social responsibility, not responsible for the the consumers.Finall y, it is noted the other primary cause of current leakage of personal information is difficulty of civi l safeguard legal rights and hard to access evidence.From this point,the author analyzes the right s difficult and hard evidence of reason, and finally put forward the corresponding suggestions an d opinions.
