Entering the 21 st century, with the development of political, economic,social change set off a new wave,urban construction pace was accelerated, but the levy on urban houses in China caused frequent phenomena of infringing upon reasonable rights of the individual,because the law does not stipulate reasonably "public interest".Although China’s Constitution,the Houses on State-owned land expropriation and compensation,Urban real estate management law and People’s Republic of China real right law are stipulated,it is no law expressly provides the "public interest" so that in different regions, the executive authorities have the ultimate power of interpretation and discourse on "public interest".Administrative organs often make improper exercise because "public interest" is not clear.This phenomena damaged the lawful private property of citizens,expanded wantonly public power and eventually caused inestimable damage to private property and other legitimate rights.By comparing the difference between the Chinese and foreign laws relating to public interest,it will reasonably analyze and discuss scholars views on appropriate discussion about public interest and other related concepts.Based on the condition of our national conditions and possession of private property under the levy on urban houses,clearing the "public interest" is essential for formulating relevant laws to consider the objective truth of important concepts.Analysis the definition of public interest is now the existence of specific problems and perfection of relevant methods, combined related legal provisions on public interests for reasonable defined, eventually restrict the public power in the context of reasonable and legitimate.It is public interests and the interests of combining so that ease the contradiction between the two.It promoted the healthy and rapid development of the social, political and economic, and provides a good environment for development on social harmony and stability.
