With the development of modern society, the quantity of car ownership has increased dramatically, the crime rate of road traffic has increased year by year, and the consequences of crime have become more and more serious. In the face of this situation, our country’s legislation and judicial made corresponding changes, mainly embodies two aspects: the advancement of criminal punishment and the expansion of the applicable charges, in order to strengthen the criminal law of our country road traffic offense.Study on road traffic offenses are mainly concentrated in Traffic Accident Crime(real harm committed), Crime of Dangerous Driving and Endangering Public Safety Crime(particularly dangerous crime) of the three charges,it have to be carried out from perspectives of criminal legislation and interpretation of criminal law.On the legislative terms, learn from foreign experience is important and necessary, in the meanwhile, common law and civil law countries for comparative traffic offenses criminal regulation is particularly important.It should be noted that modern society emerged on road traffic offenses regulatory exhibit early criminal law protection of the characteristics,may destroy the restraining criminal law, crimes against the negative impact of civil liberties, and therefore need to be interpreted to narrow down.The difference between the three offenses road traffic offenses have inextricably linked to each other, for the three sub-sector is also reasonable to limit road traffic offenses do shrink explain an important part.In view of the expansion of the legislation and the judicial field which is reflected in the road traffic crime in our country,we must abandon severe-penalty doctrine, both from the criminal legislation, criminal justice point of view, and from the perspective of a non-criminal(civil, administrative, etc.) comprehensive to regulate it in order to achieve the fight against crime and the purpose of prevention of crime.
