In terms of copyright law, it has proven to add more confusion to already confusing area of models of licensing music work. Compared with developed countries like European and American, rules of law in our country have the historical lack and there is doubt that existing models of licensing music works are inability to keep pace with present music marketplace in our country. Reasonable copyright rules should well effectively coordinate the interests between each subject, especially to endeavor to balance the public obvious desire for music against the rights of the copyright holders to be compensated for their musical works sold or disseminated over the Internet. In music transaction, copyright is main content of the process of music marketplace. If values contained in music works were beyond realization, music marketplace would face to “transaction failure”. Actually, licensing or trading of musical work not only depends on the author and the public, but also needs an online system built on access, innovation and compensation. The key of online licensing is securing the prompt availability of the maximum amount of compositions with clear, ideally minimal, licensing requirements that allow and provide them certain reasonable licensing terms or choices of licensing, which related to these elements of online licensing—copyright management information, collective management organization and rules of licensing.
