The Study Of Rational Safeguard Rights Fr Om The Perspective Of The Awarness Of Citizen Rights

With China involved in gradual integration into the wave of globalization, the deepening market-oriented reform, the improvement of democratic politics, and the rapid development of the Internet create good environments and favorable conditions for the awakening conscious of civil rights. The higher level citizens are aware of rights, the more eager they want to realize those rights. When the rights of citizens suffered from unreasonable infringement, citizens will stand up for their rights instead of being silent. Unfortunately due to various factors, the conduct which should be reasonable and legal evolved into some irrational mass incidents, threatening the healthy development of the society. It is therefore imperative to dig out the root causes of irrational rights of citizens. Only in this way can we explore the corresponding solutions. This paper takes Shifang 7.2 event as the typical example, from four sections to explore the rational rights. The first part includes: the research background and significance, thesis review, the definition of key conception, the application of the theory, as well as research innovation and difficulties. The second part analyzes the entire Shifang event, including review of the entire event, insight of the Chinese safeguard legal rights status, and the negative effect by non-rational defending rights. The third part mainly analyzes the plight of non-rational safeguard legal rights, including the lack of credibility of the government, which citizens can not get full trust; citizens own factors to hinder legal rights rationalization; lack of public defenders system, and the inefficient mechanism. Section IV points out the way to Citizen safeguard legal rights: rule of law, which includes the need for analysis of citizen rights law, the conditions of China, and the countermeasures analysis of civil rights realization:improve laws and legislation about depending the rights,provide a good environment for citizens;strengthen the government itself,improve the credibility of the government;strengthen the construction of civil society,cultivate civic virtue;groom the legai awareness of citizens and government;improve judicial system,re-establish judicial authority.
