Research About Illegal Operation Governance Under The Respective Of Rule Of Law

Since the eighteenth congress of The party, along with the strategy of governing the country according to law all-round propelling and governance modernization goals putting forward, it provides a new perspective for the management and development of industry. Road transport industry as an important part of the third industry in our country, shows up many problems in the reform and development. Among them, the illegal operation is increasingly serious, and it has become the ills of industry governance. The existing literature more expounds the illegal operation’s definition, cause, harm, local governance dilemma and countermeasures etc, but there is little to research the illegal operation in-depth from the perspective of the rule of law. Based on this, this paper takes the implementation of the strategy of governing the country according to law all-round propelling and the implementation of governance modernization goals as the research background, and combines with the current governance status of illegal operation, the paper researches the following aspects.Firstly, this paper explains the related theories about the illegal operation, the rule of law and governance, and then draws a conclusion that governing illegal operation is imminent from illegal operation concept, cause, personnel composition, operating area,harm etc, thus concludes the necessity of governing illegal operation under the perspective of the rule of law. Secondly, this paper analyzes the present situation of current governance about illegal operation, mainly includes three aspects: first is the effectiveness of governance. Analyzing and summarizing the effect of illegal operation through governance subject, institutional, results, impacts etc. Second is the existing problems in the governance. Analyzing the existing problems about the governance subject, legal system, methods, form of law enforcement, public support.Third,analyzing the deep reason on the existing problem of governance. Finally, based on the previous research on governance, this paper puts forward ideas and initiatives about governance illegal operations in accordance with the law, specifically including the following five aspects: first, strengthening the rule of law team construction of road transport; second,establishing and improving a legal system of road transport; third, standardizing road transport law enforcement; fourth, improving road transport supervision system; fifth is to enhance people’s awareness of the rule of law.
