A Study On The Influence Of The Competitive Neutrality Rules To The Reform Of State-owned Enterprise Of Our Country And The Countermeasure

In recent years, emerging economies such as state-owned enterprises in the international economic performance on the market caused by the height of the developed countries such as America and Europe.They believe state-owned enterprises with government support gained a competitive advantaged,not only creates distortions in the allocation of social resources,but also for the international economic order threatens fair competition. Therefore, developed countries represented by America to actively promote the “competitive neutralit” ruls in various internation organizations, trade negotiations and other occasions, intended to carry out a newgeneration of competitive neutrality rules prevailing international trade and investment rules.The core competitive neutrality rules is to ensure a fair competition environment, although our country has no formal or legal document can a clear definition of the concept of competitive neutyality,but try to eliminate make state-owned enterprises with the support of the government of the private enterprises have no unfair competition advantage of the target in line with the direcition of the state-owned enterprises in our country.This paper proposes competitive neutyality rules, the origin and development of the sort, and to the explore the concept of the competitive neutydlity and its legal basis, through the analysis of the current situation of competitive neutrality in our country and the influence of state-owned enterprises in china,learn from foreign experience in the application of competitive neutrality rules,based on the characteristics of China’s basic national conditions and economic development, to construct our country’competitive neutrality rules, and to improve the “anti-monopoly law” implementing competition neutrality to provide legal support to our country.
