Study On Escape From Traffic Accident Crime

Problems of decision related to hit-and-run have been the focus of the criminal law circle. Regulations and rules in the law of traffic offences define the two "escape" with the same explanation: escape shall be found guilty of committing multi-act crime, but not guilty of committing combinative crime; the decision of "escape" shall be applicable to the statement of evading legal accountability and the statement of evading the duty of rescuing, of which the essence lies in the nature of omission and at which case the statement shall be improved in accordance with the legal hierarchy of duty; whether the decision of "escape" shall be convicted of committing a crime is against the principle of suiting punishment to crime; the subjective crime of "escape" and "death caused by escaping" shall be dealt with as negligence, for which there is no need to decide respectively; voluntary surrender after hit-and-run has no influence on the decision of escape, among which those that are in accordance with the conditions of voluntary surrender shall be dealt with as voluntary surrender.
