Extraction The Law Protection Of Minor Personal Information

In the 21 st century, personal information is becoming an important social resource. With rapid development of information industry, human society strides towards the information age. Personal information is retained in the various areas such as shopping malls, banks, administrative bodies, etc. When individuals get involved in social activities process, personal information is collected, stored, transferred, processed and utilized inadvertently. With the popularity of smart phones especially in recent years, the trade of personal information, human flesh search, spam messages and other personal information issues attract people to pay attention to the personal information problems. In this paper, the discussion about the protection problem of minors’ personal information is based on the particularity of minor groups whose personal information is more socially significant than adults’. Appropriate protection can promote more attention on juvenile protection issue in society, which enables minors to have physical, mental, ideological and intellectual developments and eventually grow into qualified citizens.Besides the introduction and conclusion, the paper is divided into four parts:In the first part, the passage introduces the definition and particularities of minors’ private information. It also clarifies private information and private information of the minors. Meanwhile, briefs the rights attribute of private information, and the particularities of the minors’ privacy.In the second part of the thesis, to proof the necessity of protecting minors’ information, we will analyze the recent situation in this area. And then present the problems that exist in the legal system, basing on the current legislative sate and the infringement cases in China.In the third part, we will discuss about the foreign laws in protecting minors’ private information, by learning the pattern of legislation and the way of protection, both from the common law and civil law countries. So that we could take the advantages as our reference.The point of view in the fourth part, is base on the analysis of the foregoing parts of this thesis. There are some thoughts on how to improve the legal protection of minors’ information, including the confirmation of the rights of minors’ private information, the study of legislative mode, the establishment of legal institution, and so on.
