The Research On The Improvement Of Environmental Liability Insurance System

As a kind of social relief way, environmental liability insurance system has the function of environmental risk management and social relief. Relying on these advantages, it makes up and enrich the traditional environment infringement relief way. However, such as the problems that the research on environmental liability is weak, the legislation is insufficient are obstacles to its development. The New Environmental law in article 52 provides that“the state encourages environmental pollution liability insurance”, laid the legal foundation for environmental liability insurance system. At the same time, the foreign experience tells us that to strengthen legislation, establish specific systems and reinforce the government’s protection function is an optional path.In addition to the introduction and conclusion of this article, it is divided into three parts. In the first part, comparing with the traditional environmental remedies, to discuss the function of the environmental liability insurance system. In the second part, to talk about the situation of the environmental liability insurance in China and analysis the problems. In the third part,through investigating the environmental liability insurance system in other countries, learn the useful experience, provide reference for the perfection of China’s environmental liability insurance system.In the fourth part,analyzing the existing problems of environmental liability insurance in China, puts forward the proposals to adapt to China’s national conditions of the road in the environmental liability insurance.
