Study Of Inheritance Of Internet Virtual Property

The development of internet economy contributed to the growth of social wealth and enrich the type of property. The ownership of internet virtual property has gained much more attention of people due to the increasing number of legal disputes about it. However, in comparison with the rapidly developing society, the related legislation in our country still lags behind and did not provide a better protection for the development of internet economy. This paper focuses on the area of virtual assets in net and try to explore its legal definition and ownership issues, in addition, proposes some advices about the ownership of internet virtual property.Internet virtual property could be the object of inheritance, the key is to demonstrate its property and legal attributes. This study introduces and analyses the main four kinds of theories in recent years when researches the legal attributes of virtual assets in net, and adopts the property right theory based on considering rights protection of users and legislative convenience; illustrates internet virtual property conforms to the legal feature of property and should be incorporated into the scope of the heritage in Inheritance Law.The main obstacles to internet virtual property inheritance are the network virtual property inheritance which is not involved in network service agreement as well as the conflicts between network virtual property inheritance and privacy, and these issues should be considered when construct the network virtual property inheritance system. Through the method of comparative study, with the legislation experiences learning from foreign countries, this article proposes the idea of internet virtual property inheritance system combines with the actual situation in China, in order to perfect the legal protection of network virtual property and solve the problem of internet virtual property inheritance.
