Research On Doctors’ Attentive Duties In The Liability Of Medical Damage

In recent years, China’s medical disputes is increasing as. What’s more, serious incidents caused by medical disputes happen occasionally. This condition restricts the development of the medical and health seriously, threaten the safety of patients and physicians, and hinder the construction of harmonious society threaten in China. Therefore, we must take measures to solve the problems.Doctor’s attention duties are the core of the thesis,and related research are done from six aspects. Some suggestions are provided in order to solve medical disputes.Chapter 1 is about the topic of background and significance, the introduction of status research, article structure arrangement. Chapter 2 is about the definition the attentive duties of doctors synthesize many experts’ research production and discuss how to identify the attentive duties of doctors. Chapter 3 is about the foundation of the attentive duties of doctors, includes scleroidlegal regulations, soft medical experience and contractual liability in the basis of patients’ view. Chapter 4 is discuss violation of doctor’s duty of care,in the basis of reasonable doctor standard, consider medical standard, regional, specialization, urgency, medical practice and the particularity of medical activities,and the defenses of violation of doctor’s duty of care, includes related laws, admissibility risk and patient’s consent. Chapter 5 takes advantage of the above theory to do some case analysis reports. Chapter 6 is about the problems and improvement of doctor’s duty of care.
