The Study On Guardianship Problem Of Left-behind Children In Chinese Rural

In recent years, the problem of left-behind children in rural areas has aroused great attention from the central government and local government as well as the community. As an inevitable phenomenon in the transition period of our country, the problem of left- behind children in rural areas will not disappear in the short time. Rural left- behind children as a special social vulnerable groups, facing problems of life, learning, security and other aspects are increasingly serious. By analyzing the rural left -behind children generation background, the existing mode of guardianship, the causes and negative effects about lack of guardianship, drawing lessons from the experience of the foreign minors guardianship system, and according to current situation of our country, the paper will put forward the views of the measures to solve the custody problem of China"s rural left -behind children, and hope that can help to protect legitimate rights and interests and grow healthy of our country rural left-behind children.Papers in the structure is divided into five parts:introduction describes the background of the selected topic, theoretical and practical significance of the research, the research summary and full text of the basic contents and framework of induction and the research methods and deficiencies of this paper. Firstly the paper define the rural left -behind children and the guardianship of rural left-behind children, then analyze the characteristics and shortcomings about several kinds of guardianship for rural left-behind children, and expounds problems caused by the lack of guardianship. The next paper analyze the reasons for the emergence of a large number of rural left-behind children, and left-behind children in rural areas lack of guardianship. This paper also study the minors guardianship system in several countries, which are representative of the continental law system and common law system, and explain the significance of the foreign guardianship system to our country. According to the defects of the guardianship system of the left -behind children and the advantages of the foreign related system, the paper puts forward the suggestions to improve the guardianship system of the rural left- behind children in China.
