The Criminal Procedure Law of China explicitly states that human rights should be respected and protected. Besides, some specific provisions governing case-filing, investigation, prosecution,trial and execution are also added. As judicial authorities, the Public Security bureaus are responsible for cracking down criminal activities. The protection of suspects’ human rights is an unavoidable problem facing public security bureaus. How to implement relevant measures and provisions determines whether suspects’ human rights can be respected or protected in the real sense. Throughout the criminal proceedings, summons by warrant or subpoena suspects are suspects in criminal proceedings is to enter the initial stage, at this stage, whether the human rights of criminal suspects is guaranteed, directly related to the fairness of the criminal proceedings and impartiality. In many injustices happening in our country, mostly because investigators in the subpoena or subpoena stage lynch suspects or due to torture. Therefore, as the initial stages of the criminal proceedings, during the summons or subpoena to protect the litigation rights of criminal suspects and human rights is particularly important.Starting from the phase of subpoena or summon by warrant of suspects, this paper offers a systematic introduction to the protection of suspects’ human rights in that phase and then probes into the measures as how to safeguard suspects’ human rights and existing problems.
