| Our country is one of the most significant ecological and vulnerable environment and most widespread ecological zones in the world.Ecological fragile areas in our country mainly involves 21 administrative regions(Province,municipality and direct-controlled municipality). Shaanxi province where I grew up is one of the northwest ecological fragile areas,in addition to the formidable natural condition and fragile ecological environment,the mounting ecological environment crisis is also caused by extensive pattern of economic growth and the prominent contradiction between human and land,and backwardness of regulation and supervision technology.Establishing ecological compensatory mechanism not only recover and protect the basin ecological environment has been imperative,but also it is inevitable choice of nation and regions of innovative management mode. Since 2010,the state council has already planned ecological compensation to regulations and legislation,which led by the national development and reform commission,also with the ministry of finance, the ministry of land and resources, environmental protection department, ministry of water resources, agriculture and other 11 departments jointly working group,drafting of the ecological compensation regulation.Draft has been formed at present stage and in the midst of the consultation.Although the legislative conditions are not mature enough, it’s still need to progressive legislation activities, as a very urgent task of China, the research establish and perfect the mechanism of ecological compensation idea has won a wide recognition.Using economic means is the essence of ecological compensation,which will solve the problem of environmental protection, however it is need the specification of laws, regulations and policies to guide and guarantee the implementation of ecological compensation.This paper established the northwest ecological fragile area of river basin ecological compensation legal mechanisms perspective in order to make full use of the empirical research method, literature research and comparative analysis research method, through the clear present situation of northwest ecological fragile area water resources, analyzing the successful experience of river basin ecological compensation domestic and overseas and set condition of Wei River as an example,Induces at the legal level and the existing problems in the construction of river basin ecological compensation and difficulties, also put forward suitably for suggestions and solutions.This paper first puts forward the concept and definition of ecological fragile area, introducing barriers in the development of ecological compensation and the status of resources in the northwest ecological fragile areas; and use these existing problems are analyzed in foreign exploration of river basin ecological compensation and the domestic areas of river basin ecological compensation research for reference. At last, through the empirical research of Wei river example,analysis the procedure as a case study in order to establishing the perfect laws and regulations, and introduction of market-oriented mode, establishment the mechanism of cross-regional cooperation level to improve the ecological compensation and ecologically fragile area northwest river basin ecological compensation, for build protection ecological fragile area northwest basin environment perfectly, and promote the harmony between man and nature for the purpose of institutional arrangements and a long-term mechanism. |
