Study On Prison Administration System Reform At The Background Of Enterprises’ Separation From Prison In China

Prison as a national judicial institution is a special place, which with the function to prevent and punish crimes. With the reform and the gradual improvement of China’s unique economic system, there is a series of contradictions and problems of the prison administration. The management system in the mode of combining the prison and enterprise does not fit the prison’s requirements; even restrict the development of prison. In January 2003, prison reform goals are put forward by the Ministry of Justice, the main idea and the aim is to change the prison management and Enterprise integrated to ensure proper functioning of the prison. In 2008, the Ministry of Justice decided to implement prison reform throughout the country, in which the separation of prison and enterprises are the key. Until 2011, the national penitentiary system has been basically established two sets of prison reform and enterprise operation.The paper takes literature research, comparative analysis, and empirical analysis three methods study on the problems of prison administration system reform in China. In the context of prison administration reality in China, and make sure the current achievements in the prison administration system reform in China, such as the essence of prison law enforcement functions has been purified; the infrastructure and hardware devices of prison has dramatically improved; prison enterprises had good economic development; the workers’ treatment has improved significantly. But there are still some problems in the management system of our prison, such as prison enterprises lack legislation; prison’s corporate position was not clear; prison funding safeguards were not in place and prison oversight mechanism was not perfect. In response to these problems proposed in this paper from the following four aspects of perfection:refinement of the prison management system principles; perfecting the reform of prison administration system; specifications development of prison enterprises and make sure the cooperation between the prison and the prison enterprises.
