At present, China’s aging problem is increasingly serious, the proportion of elderly population has been rising, the number of unmarried cohabitation in the elderly are on the rise. The elderly unmarried cohabitation behavior in later life no longer lonely, spiritual comfort each other, but unmarried cohabitation also increased its instability in later life, and come from property, with children in all sorts of problems. The existence of things has its two sides, this article’s view is: the elderly unmarried cohabitation is not do more harm than good.This paper will be divided into four parts: the first part is the cause of the elderly unmarried cohabitation; The second part is the analysis of the pros and cons of the elderly unmarried cohabitation and ideas of this article; The third part is to the plight of elderly unmarried cohabitation regulation analysis; The fourth part mainly is aims at regulating the dilemma, as far as possible to find solutions, to fill the blank of the law.Because our country legal protection of the object is the men and women in marriage, so during the elderly unmarried cohabitation or broken relationships, there is no effective remedy at the end of the dispute, for the elderly in later life has brought great inconvenience. This creates a light spot unmarried cohabitation protection of the rights and interests of the elderly. We should look at this problem from the view of dialectical, development, and the elderly unmarried cohabitation in the face this problem, actively to deal with is the positive solution to get out of the way.
