Discussion On Abolition Of Delegated Legislation In Special Economic Zones

Delegated legislation is a kind of privilege which provided to the special economic zones in our country.It aims to help the five special economic zones to achieve the function of experimental legislation.Delegated legislation played an irreplaceable role in the the reform of the special economic zones and the process of opening to the outside world.It is also the most significant advantage of the special economic zones.But with the deepening of the construction of legal system, delegated legislation gradually exposed serious theoretical defects,and it causes the difficulties of legal application in the courts.The conflicts of laws in the special economic zones threats to destroy the unification of our legal system.Delegated legislation is only a makeshift which helps the special economic zones to break through the unsuitable laws and set up a new market economic system.Nowadays, great changes have taken place in up and down all over the country.The National People’s Congress has to review the necessity of delegated legislation under the new situation.This article writes to advise The National People’s Congress to abolish the delegated legislation in the special economic zones.Delegated Legislation has lost its reason to exist.We should not be at the expense of destroying the unification of our legal system to continue to maintain an obsolete system.As a city divided into districts,the special economic zone should make good use of the legislative power.If there is need to adjust the applicable law,The National People’s Congress can accredit to the special economic zones separately.
