Study On The Divisions In Civil Trial Procedure Of China

For a long time, the theory and practice circle of our country have made a lot of research on the system of civil procedure division.On this basis,the case division system finally in 2012, confirmed by legislation in the civil procedure law.But not very detailed.Relevant laws and regulations for this system are worthy of us to explore for the issue.This paper,will focus on the legislative focus of controversy, explores the practice and legislation problems in the division system. on the basis of these,further put forward the suggestions of perfecting our country’s civil case division system.The paper consists of three chapters,around the themes of civil procedure division. The main contents of each part as follows:Introduction: Simple Explanation of the civil division system, it explains the significance and background of this writing and this article.The first chapter is the practice review for civil cases division programs in our country. Try to find the problems existing in the practice from the general situation on the civil cases division, and analyze the cause of problem.The second chapter is focused on the legislative status quo shunt civil cases.Including Interpretation of the law, and analyze the legislation. Interpretation of the law, and analyze the legislative issues, such as procedures apply, cases division options. On this basis, further summarized the legislative focus of civil procedure division.The third chapter is about the program building of the system of civil cases division.Put forward a sound vision for the system of civil procedure division,from the perspective of standard procedures apply,cases division options,trial management,etc.
