On The Legal Protection Path Of Chinese TV Program Mode

With the rapid development of the television industry, all kinds of entertainment programs have come into being. Especially in the past two years, there have been a variety of reality TV shows on the TV screen. As a result, the problem has emerged. The main problem is that each satellite TV station to imitate each other excellent television programs, which led to the homogenization of the television program is serious. The state general administration of press and publication, radio and television on the website of the notice on strengthening the management of the reality TV show has aroused the attention of the press and law scholars on TV program mode protection. TV program mode refers to the framework of a television program, this framework is a combination of multiple elements, through this framework, the audience can recognize the theme of the program, the audience can also recognize the program is distinguished from other programs. At present, the television program mode of China is relatively new concept, we have no legal protection of a television program mode. And because of the television program mode of transaction is increasing. Therefore, there are a many cases about disputes in this regard. Based on the analysis of foreign related cases, this paper tries to analyze the reasonable way of China’s legal protection TV program mode.First of all, this paper defines the concept of TV program mode by listing and analyzing domestic and foreign scholars on the definition of television program mode, and by exploring its legal nature to define the legal status of television program mode. Secondly, it analyzes the current situation and necessity of the legal protection of TV program in our country, based on the problems existing in our country’s TV program mode, and combining with the legal disputes arising from the practice. Thirdly, it analyzes the judicial practice of the legal protection of TV program mode in foreign countries, in order to achieve the guidance of our country in the legal protection of television program. Finally, combined with the actual situation of our country, we try to explore a suitable legal protection path for China’s actual conditions, so as to fully and effectively protect our country’s television program mode. Namely, to seek a copyright law based, supplemented by anti unfair competition law, combined with the trademark law, patent law, contract law and other legal protection system to protect the Chinese television program mode. This is the innovation of this paper.
