With the proliferation of electronic computers, the internet and modern communications technology, modern society has to deal with new forms of criminality such as the theft of network virtual assets, illegal intrusion of computer systems, illegal interception, manipulation of computer data, etc. At the same time, traditional criminal acts are also taking advantage of high technology such as swindling through the internet, online organized gambling, online prostitution, online terrorism, etc. Evidence gathered electronically from computers and the internet is growing by the day and has become a difficult problem in the prosecution of criminal cases. Electronic evidence is different from traditional evidence. As such, the rules surrounding evidence in criminal litigation do not apply entirely. The research I am conducting is around the collection and examination of electronic evidence for criminal litigation. I will tackle this topic by first looking at the common concepts and special characteristics surrounding electronic evidence in criminal litigation and exploring the following points:Part I: Analysis of the characteristics and categories of electronic evidence. This will serve as a theoretical basis for the collection of electronic evidence.Part II: Description of using warrants to collect, extract and solidify electronic evidence which will be the basis for the next section.Part III: Analysis on examination of the legality, veracity, objectivity and interrelatedness of electronic evidenceLastly, I will probe into the problems surrounding the topic of electronic evidence in current criminal litigation and lay out m personal musings on the topic.
