With the rapid development of economy and the improvement of our living standardand quality, citizens’ demand to their own rights is higher and higher. In the Constitution ofthe People’s Republic of China, citizens have the right to get education, and sports as animportant part of education, sports right is the basic right of students. None has right toabuse or deprive students’ sports right. Therefore, school sports status and meaning arefairly unique. But because of the accidents of students in the class or extracurricular sportsactivities in recent years,a lot of cases concerning compensation for damage have happened.High compensation and legal responsibility make kinds of schools at all levels havenegative thoughts to physical education and extracurricular sports activities. They are notwell aware of the long-term effect of physical education and extracurricular sports activities,and they think it is a waste to buy sports equipments, so they cut bake the amount of gymclasses. What’s worse,some schools assign other teachers who are unprofessional to replacegym teachers. Middle school stage is the apparent period of student physical development,so reducing physical activities and extracurricular physical exercises may have a badinfluence students’ height and physical qualities.The study shows the current situation of sports right of the middle school students inChifeng, and tries to to solve the problem of junior high school students’ sports right so thatthe students can have a clear understanding of their sports right as well as inspire andcultivate the consciousness of the students to protect their own right. Besides, the articletries its best to make the school leadership and PE teachers take the student as the mainbody, and guide students to establish the idea of lifelong sports and cultivate the habit ofstudents to participate in physical exercise, so as to guarantee the students’ sports right.Thispaper takes the school as foundation of research, the middle school in Chifeng asinvestigation object, using the literature material, interview method, questionnaire surveymethod, mathematical statistics, logic analysis and other research methods to researchschool students’ sports right in theoretical and empirical sides. In the theoretical part, thispaper discusses the basic theory of the sports right, and mainly take the constitution, thesports law and education law as the foundation. In the empirical part, the passage analyzethe survey results of sports health right, sports equal right,sports education right and sportsawareness right strictly.The conclusion shows students’ right are violated in differentdegrees,especially sports education right and sports awareness right.In the countermeasurespart the paper points out that students’ sports right and its assurance needs to be protected and improved by sports legislation.Besides,the passage puts forward feasible advice inaccordance with specific conditions in Chifeng.
