Enterprise Seasonal Labor Law Studies

Our country is in the stage of economic and social transition, subject of labor relations’appealing to their interests shows a diversified development trend, conflicts in labor relations constantly happen, the number of labor dispute cases remains high. So it is a tough and heavy task to build a harmonious relationship of labor relation.As process of running an enterprise is affected by various factors, such that some enterprises have some seasonality in the demand for labor. Seasonal employment is not only able to meet the enterprise’s needs of periodic employment, but also job flexibility for laborer, with a features of focused working time, big staff mobility, enterprise labor flexibility. In our country, in order to regulate labor relations, labor legislation claim that labor required to sign a written contract between the employer and the employee. However, there are many problems in seasonal employment of enterprises in the real world.In this paper, we analyze the situation and the specificity of seasonal employment of enterprises through. And combining the changing rule in seasonal employment of enterprises, we discuss the problem in the process of seasonal employment of enterprises, such as long working hours, remuneration unreasonable, pay social insurance is not standardized, vocational skills training imperfect. Focusing on these problems, we studied how to improve working hours and wage system of corporate seasonal employment, strengthen efforts to propaganda, participate in social insurance in variety ways and improve the enterprise seasonal labor vocational skills training in order to protect the legitimate interest of laborers.
