On The Settlement And Balancing For The Interest Sacrifice In The Human Resources Management In Our Country

Along with the development of China’s reform and opening up, companies of all sizes have established and developed. In this course, layoffs and pay cuts are the main forms and content of interests sacrifice under the perspective of human resource management. If layoffs and pay cuts are carried out in some unreasonable and unscientific methods, it would intensify the contradiction between the performers and the victim, or even lead to the violation of the law.In the Fifth Plenary Session of the Sixteenth Congress, our Party clearly put forward the principle of "Pay more attention to the fairness" to change the present policy. Nowadays, we have a lot of provisions in our country’s law to protect the worker’s interest from being violated. But there are problems in the actual operation, so that the interest of the workers are sacrificed, and the worker’s rights safeguard is always a dilemma in the arbitration.Through the research and analysis of a various of the ancient and modern typical cases in all countries, the writer finds there are issues of the arbitrary of the managers; non-procedural; the weak consciousness of civil rights; a wide gap between the interests and the weak function in the third-part of arbitration "and so on.Combined with the theories of the Western scholars, this paper presents the viewpoints of "the improvement of the social democratic legal awareness; programmatic management;transparent management; to strengthen the third-part organization; to strengthen the super vision and the evaluation the sacrifice behavior; the balance of the interests and feedback". The writer hopes through the reasonable program of sacrifice and the supervision and evaluation of the interest sacrifice, so that the interests sacrifice in human resources management can be more fair and it could resolve the social conflicts caused by the interest sacrifice. Thus, this high-moral sound ethics would make itself the real sense,and it would no longer be the front for the dictators to use it to meet their selfish desires. This is also the goal sought by the interests sacrifice theoretical research workers.
