Research On The Legal Systems Of Invading Alien Species Invasion

With the the opening to the outside world deepening and the degree of economic globalization continuously improving,the problem of alien species invading in China is gradually developing a serious situation.Since the 80th generation of the last century,China has formulated and revised a series of legal and regulatory documents,such as?People's Republic of China Entry and Exit Animal and Plant Quarantine Law?,?Law of the People's Republic of China on Marine Environmental Protection?,?Law of the People's Republic of China on Agriculture?,?Environmental Protection Law of the People 's Republic of China?.Although these documents contain provisions on alien species invasions and play a role in combating alien species invasions,due to the presence of multiple defects,the role of existing legal systems in combating alien species invasion also have limitations.So,China should draw on the experience gained by the advanced developed countries in combating alien species invasion,and consider the current lack of the legal system of controlling foreign species invasion,combine Chinesenational conditions,to complete the legislation of preventing Invasion of alien species in China,including completing legislative model,legislative purpose,legislative principles,legislative content,relevant legal system and supporting mechanism.In the structure of the article,the text is divided into five parts:The first part is an overview of invasive alien species.This section mainly explains the basic concepts of invasive alien species,including the concept of alien species and the concept of invasive alien species,and analyzes the three major ways of invasive alien species,including natural invasions,unintentional introduction and intentional introduction,and analyzed the various hazards caused by the invasion of alien species,such as to bring huge economic losses to the country,endangering human life and health,destructing biodiversity,resulting in the endangered or extinct of indigenous species and seriously endangering ecological security and national security.The second part is the legislation of alien species intrusion prevention and control in China.This part analyzes the current situation of the legislation of alien species intrusion prevention and control in China,and analyzes and evaluates it,and finds out some deficiencies in the legal system of invading alien species in our country in order to propose better improvement measures and solve the countermeasures.The third part is the practice and experience of international alien species invasion prevention and control.This part introduces that The United States,Japan,Australia,New Zealand,Canada,Britain and otherdeveloped countries has developed a sound control of alien species invasion of the regulatory system,on the basis of comparative analysis,the article draws lessons from the relevant experience,and provides a reasonable reference for the future improvement of the legal system of alien species invasion and control in our country,such as legislative model,management system and legislative content.The fourth part is the perfect countermeasure of the legal system of invading alien species in our country in the future.This part mainly includes the establishment of a special law of preventing the invasion of alien species,strengthening and improving the management system for alien species,establishing a unified mechanism of functional departments,establishing alien species invasion path identification mechanism,further improvimg the relevant inspection and quarantine system,improving the relevant risk assessment system and administrative licensing system,improving the follow-up monitoring and emergency response system,improving the relevant laws and regulations of the invasion and control of alien species,clearing the legal responsibility and improving public participation.The fifth part is the summary and prospect of this paper.
