A Preliminary Study On The Path Of Convergence Between Administrative Law Enforcement And Criminal Justice In The Field Of Environmental Protection

In recent years,there have been more and more pollution problems and paroxysmal environment events.Environmental pressure is increasing.Meanwhile,the environmental emergency management system is unsound,leading the environmental safety situation serious.Therefore,on one hand we should strengthen the administrative supervision,on the other hand,to the alleged environmental crime crimes,we need to strengthen the effective interface between environmental administration law enforcement and environmental criminal justice to avoid"administrative punishment instead of penal punishment" "guilty but not punished".What's more,we will reduce the damage to the environment through both administrative and criminal punishment.However,at present,the interface between environmental administration law enforcement and criminal justice has many problems:the interface system is not practical,and low-hierarchical.The transfer time standard,the evidence conversion and the interface leading institution are not clear,among which there is a lack of effective interface.At the same time,the procuratorial organs can't constantly keep effective supervision,causing the interface of the two laws and information transfer not smooth.The leading reasons are also exist in various organs of environmental law enforcement departments.On the basis of the analysis of these problems and reasons listed above,the paper raises targeted and practical countermeasure suggestions,that is,from the aspects of clearing interface leading mechanism,improving the way of interface,improving the relative legislation of the interface of the two laws,and perfecting the interface program,the government will promote the process to go on smoothly.
