Research On Environmental Public Interest Litigation In The View Of Law For Construction Of Ecological Civilization

With the rapid development of our country's economy,too many enterprises and individuals emphasize so much on money that they neglect the development of environment,which leads to the pollution and worse of environment.The Third PlenumSession of the 18 th Communist Party of China Central Committee made a decision that a country must build a complete system and use system to protect the environment in order to construct environmental culture.Facing new social situations,judiciary authorities and administrative body must study the central party and government authorities' new ideology and thesis on environment culture's enforcement construction,concentrate minds,fully enforce works on lawsuit and judgment about environmental sources,employ laws to sanction behaviors.Make sure that policy that protects environment and natural resources take effect to maintain and protect people's health,accelerate society's sustainable development.In 2015,Standing Committee of the National People's Congress authorized 13 provinces that they could carry out public welfare litigation experimental work and it achieved a lot.During the process of experimental work,the qualification of lawsuit was being broadened gradually,the procedure of lawsuit is clear and unified,organs for inspecting discipline enforced the law by inspecting and advising,which saved the cost of enforcing the law.Environmental civil public welfare lawsuit and administrative public welfare lawsuit become the main two forces that protect the environment.However,during the process of experimental work,there emerged many problems.This paper standing on public welfare lawsuit experiment work,comes up with methods to solve the problems of our country's public welfare lawsuit against the background of legality construction of ecology culture.The methods mainly include: keep citizen well informed,encourage citizen to well participate,improve the qualification of main body that organs for inspecting discipline prepare law actions,improve organs for inspecting discipline's ability to prepare lawsuit,and meanwhile coordinate public welfare lawsuit system,construct the system that make for ecology environment and afford lawsuit cost.The methods mentioned above that are effective are based on our country's current situations,which are used to perfect our country's public welfare lawsuit system.
