Research On The Legal System Of Prevention And Control Of Oil Spill Of Marine Engineering In China

With humans' increasing demand for marine resources, especially for the petroleum resources,the career of marine engineering is going to flourish. At the same time,the accidents of oil spill pollution of marine engineering happen over and over again. As the oil spill of marine engineering spreads widely and the hazards of it range for a long time, it has become one of the main threats to the sustainable development of marine environment. In recent years, China's pollution accidents of oil spill of marine engineering have been going to intensify. The prevention and control of oil spill of marine engineering by law is imminent.The thesis is divided into five parts: The first part describes the background, significance,research status and the main research methods and innovations; The second part introduces the concept of marine engineering and leads out the connotation of oil spill of marine engineering. By giving two living examples of the U.S. Gulf oil spill and ConocoPhillips oil spill, the thesis cites the necessity and urgency of prevention and control of oil spill pollution of marine engineering by law; The third part analyzes the international legal system of the oil spill of marine environment, in order to provide a useful reference for China's legal system;The fourth part points out the lack of relevant legal provisions and the part of conflict, the lack of prevention measures of oil spill of marine engineering and the lack of effective compensation system of environment pollution, etc; The fifth part puts forward the specific improvement measures, including making up the inadequate legal system of pollution prevention of the oil spill, building up risk prevention system of the oil spill and improving the pollution compensation system of the oil spill of marine engineering, etc. The thesis aims at giving the relevant legislation organizations, governments and decision-making departments some references to protect the legitimate interests of the victims more effectively and to protect our marine environment further.
