A Study On Legislation Protection Of Nature Reserve In China

China has now become the second largest economy in the world,at the same time;economic development has brought different degrees of destruction of the ecological environment,so that China's ecological environment is in a relatively weak link,it needs to be improved.Since the 18 th CPC National Congress,China has begun to pay more and more attention to the construction of ecological civilization,and proposes to lay the construction of ecological civilization in the "five-in-one" overall layout of the strategic position.In February 2017,the Office of the State Council and the State Council issued "on the red line delineated and strictly ecological protection opinions",which proposed delineated ecological red line,and made a series of major decisions and arrangements for the protection of the ecological environment and ecological civilization construction.In recent years,the central policy has shown that the state has paid more and more attention to the construction and protection of the ecological environment.There is no doubt,our country has promulgated a number of relevant laws and regulations on natural protection in the legal construction of natural protection,which has made remarkable achievements in the construction and management of nature reserves in our country.But we must say that the construction of the legal system of nature reserves in China is still not perfect.Compared with the western countries with relatively perfect legal system in nature reserve,China's nature reserve has low legislative level,backward management system and legislative concept,and incomplete natural protection legal system is a general problem.Among them,a natural reserve of a lower rank of legislation,nature reserves and scenic area planning chaos,nature reserve management is relatively backward,management confusion,the Department set up nature reserves unclear land ownership,district legal liability nature protection provisions are not perfect is the concrete problem.This paper includes four parts;first of all,this paper analyzes the differences between China and foreign countries on the concept and classification of nature reserves,and clarifies the basic concepts and classification of nature reserves;Secondly,this paper leads and analyzes the problems of the legislation of nature reserves in our countryfrom the historical evolution of our nature reserves and the current situation of legislation;Thirdly,this paper draws lessons from the advanced experience of legislation through the analysis of the legal system of the nature reserve in the developed countries of the western nature reserves;Finally,this paper proposes some suggestions for improvement from the establishment of special legislation and the introduction of the red line system of ecological protection,this paper puts forward some suggestions for the management of nature reserves,such as multi regulation,perfect nature reserve planning,social co management and PPP mode.
