A Translation Report For Chapter 5 Of New Approach To Legal Translation

New Approach to Legal Translation is an academic writing on legal translation written by Susan ?ar?evi?, which is mainly about the differences of legal language and culture between western countries and how to handle the relevant problems with proper translation methods. The fifth chapter, What All Translators Should Know about Legal Texts, expounds what qualities a translator should possess in order to behave better by introducing the characteristics of all kinds of legal instruments. This report, focusing on the English-Chinese translation practice of this chapter, discusses the two typical problems encountered during the process, namely the translation of terms and that of passive voice, and proposes respective solutions. The way proposed to resolve the first problem is to follow the principles of accuracy, readability, transparency and conventionality; while the way proposed to tackle the second problem is the adoption of two translation approaches: from passive to active and from passive to passive. This report aims at demonstrating how the author, employing the translation methods she has mastered, handled the actual problems encountered in translation practice. It can provide some implications for legal translation practitioners, and also provide reference for legal translation researchers.
