Ecological philosophy,which has significance on rule of environmental law,is the value basis and proper recourse of environmental law,and is helpful to successfully carry out environmental law and reasonably resolve concrete problems.In this paper,the writer analyzes the Buddhist ecological philosophy and demonstrates the influence of the Buddhist ecological philosophy to Chinese environmental law.The first chapter is the foreword of the paper.It aims to introduce the background of the article and points out that the Buddhist ecological philosophy is used to solve the ecological crisis and the invalidations of the environmental law.The second chapter is the analysis of the relations between ecological philosophy and environmental law.The paper analyzes the meaning of the ecological philosophy and distinguishes the environmental philosophy and ecological ethics with ecological philosophy.Then the author expounds the dialectical relationship between the ecological philosophy and environmental law,and points out that the ecological philosophy is the proper recourses of environmental law and can promote the development of Chinese environmental law.The Buddhist ecological philosophy can provide the ideological basis for the proceedings of the environmental law as well.The third chapter is the interpretation of the Buddhist ecological philosophy.It includes three parts: the foundation of the Buddhist ecological philosophy,the structure of the Buddhist ecological philosophy and the value orientation of the Buddhist ecological philosophy.Firstly the paper explains reasons why the writer chooses Buddhism by illustrating the status of the Buddhism in Chinese traditional culture,the philosophy part of Buddhism and ecological part of Buddhism.Secondly,the article is based on the theory of “origin” of the view of nature of the ecological philosophy and the “theory of mind” as the core of the outlook on life of the ecological philosophy,and implicates the ecological philosophy of Buddhism.And the writer indicates that the concept of compassion is the chain of the Buddhist ecological philosophy and the environmental practice.Thirdly,the article regards the Buddhist ecological philosophy as a kind of non-anthropocentrism ecological philosophy.The fourth chapter is the demonstration of the relationship between the Buddhist ecological philosophy and the environmental legal system.First of all,this paper argues that the Buddhist ecological philosophy is consistent with the concept of sustainable development.Secondly,this paper argues that the ecological philosophy of Buddhism can respond to the ethical dilemmas of the Chinese environmental law.The fifth chapter is about the specific impact of the Buddhist ecological philosophy on Chinese environmental law.First of all,the author discusses the effects of the Buddhist ecological philosophy on systematization of Chinese environmental law.Secondly,the moderation concept of the Buddhist ecological philosophy determines the environmental law of our country should be based on the obligation.Thirdly,the concept of compassion of the Buddhist ecological philosophy asks for the extending of the object protecting by environmental law,especially in animal protection.Fourthly,the concept of the protection of spirit of Buddhism helps the return of natural reason of Chinese environmental law.And it promotes people to change their mind and realize the importance of protecting environment.The sixth chapter is the summary of this paper.
