Thesis On The Scope Of Accepting Cases Of Administrative Litigation Of Our Country

The amendment of Administrative Procedure Law of the People's Republic of China has finally been introduced to the public in the efforts of the general public, the academics and the practitioners. The amendment is committed to get out of the dilemma that there are difficulties in accepting and hearing cases and enforcing rulings. The scope of accepting cases of administrative litigation is one of the hot spots and concerns. While the amendment has expanded the scope to a certain extent, it doesn't make substantive progress. This thesis intends to analyze the deficiencies and limitations of the present law,get a glimpse at the implementation obstacles of the law before amended and analyze their causes. And it also wants to learn from the relative laws in foreign countries, so that it could put forward feasible suggestions to perfect our system of scope of accepting cases of administrative litigation.The first part is introduction, which contains introduction of the thesis writing background, purpose and significance, reviews of related studies and the research methods.The second part is the overview of the scope of accepting cases of administrative litigation of our country, including the concept of administrative dispute, administrative litigation and the scope of accepting cases of administrative litigation, the evolution of the laws of our country and its significance.The third part is comparison of current regulation and its practice status, and analyzing the causes of the dilemma.The forth part introduces the foreign countries' regulations of judicial review which includes French, German, the UN and the USA. And it discovers some valuable experience to help with us.The fifth part makes some suggestions to perfect the relevant regulations of our country. Creating fertile external environment of implementation of legal institution is as much important as improving the legal institution itself.
