Research On Our Country's Cultural Property Return Legal Issues

Cultural property which plays an important role in a country's culture can not only reflect the nation value but also people's wisdom crystallization. As a big cultural property source country, China has left precious property for hunman beings which not only records the change and progress of the world but also contains the Chinese nation's people's strong feelings. But at present, there is a big loss in our country's cultural property. Since the 1840 Opium War, a large number of our country's cultural property had been plundered,stolen or smuggled and most of them have problems of complex reasons, long time and various ways. Besides, cultural property loss refers to the strength and foreign policy of relevant countries. It seems that the return of our cuntry's cuntural property is full of difficulty. So we need to analyze the problems of our country's cultural property return.This paper mainly analyzes the legal issues of our country's cultural property return. The first chapter contains the research contents,the research purpose, and the research in-and-out our country. The second chapter expounds the definition of “cultural property” and analyze the difference among “cultural property” “cultural relic” and “cultural heritage”. This chapter also has a brief overview of the problems of our country's cultural property return. The third chapter mainly analyzes the international conventions of cultural property return. The fourth chapter expounds the foreign laws of cultural property return. The author analyzes the cultural property return legal issues of two typical countries the United States and Egypt from the perspective of cultural property source country and cultural property marketing country. The fifth chapter gives a detailed analysis of our country's cultural property return legal issues and finds out the loopholes and deficiencies. In the last chapter, the author put forward suggestions on our country's cultural property return legal issues on the basis of previous five chapter's analysis.
