| The emergence of technical investigation system has a historical background. With the rapid development of economy and technology, various types of crimes emerge after another. Patterns of crimes also gradually evolve to organized and high-tech, which adds a lot of extra difficulties during criminal investigation. In order to meet the demand of increasingly diverse crime situation, countries all over the world continue to explore technique oriented investigation. A series of high-tech, such as audio-visual equipment and computing and infrared telescopes are applied to the practice. As these practices go deeper, technical investigation measures are more mature and become an important way of investigation.Technical investigation legalization is a major advance in the field of Criminal Procedure. Its legislation idea, "punish crime, protect human rights”, is also in the line with Chinese basic national conditions. However we must realize clearly that the natural attributes of the technical investigation determine the existence of its cons. Because of technical investigation's confidentiality, technicality, and enforceability, as a "double-edged sword", technical investigation strongly fight against crime, while can easily infringe the basic civil rights. |
