Research On The Legal Protection System Of The Contracted Management Of Rural Land Mortgage Loans In China

The contracted management of rural land in China has experienced a process from banned flow to support and encourage flow. With the further development of rural economy, the restrictions to the contracted management of rural land circulation the practice has failed to keep pace with the demand for the development of rural production, is not conducive to further liberate the rural productivity, and thus to the regulations of the state, the timely adjustment. Such as the property law of 2008 will be qualitative to the contracted management of rural land as a kind of usufructuary right,on the right to the contracted management of land mortgage problems again, so as to make the the contracted management of land mortgage has a theoretical basis; Held on November 12, 2013, 18 by the third plenary session of the "the central committee of the communist party of China on comprehensively deepen reform certain major issue decision", etc., made clear the central government's attitude towards land mortgage business.
