Research On The Legal Issues Related To The Right To Mortgage Right At Maximum Amount In Practice Of Commercial Nanks

The right to mortgage at maximum amount is widely used and favored by the commercial banks because of its flexibility and convenience, and it plays a great role in the credit business. But due to the imperfection of the relevant legislation of the right to mortgage at maximum amount, commercial banks and other mortgagee meet many legal problems in practice. So it has very important significance to clarify the problems encountered in practices of the right to mortgage at maximum amount, clear the key concept of the right to mortgage at maximum amount and solve the problems in the process of registration of the right to mortgage at maximum amount.In this paper, the author discusses the overview of the theory of the right to mortgage at maximum amount and its role in the commercial banks in the first part, in the coming four parts the author conclude and summarize the legal issues related to practices of the right to mortgage at maximum amount, which are all from the author's experience in bank. Among them, the second part discusses the validity of the credit agreement and the terms of its guarantee, which is often used in commercial banks.The third part discusses the scope of the right to mortgage of maximum amount through respectively discuss the embedding issue of credit agreements, and the fourth part mainly illustrate the setting up and the changing of right to real estate mortgage at maximum amount and the fifth part describes the determination of the right to mortgage at maximum amount. At last, the author summarizes the reasons of the legal problems arising from right to mortgage at maximum amount, and puts forward some suggestions to solve the problems.
