The crime of theft, is refers to the illegal possession for the purpose, to steal others possession of a larger amount of property, or multiple theft, burglary, carrying weapons theft and pickpocket behavior. Theft in understanding and applying mainly exists the following problems: the cognizance of the crime and non crime, the cognizance of this crime and other crime, and the purpose of illegal possession of identification. For the understanding and application of the crime of theft, more in line with the purpose of criminal law and social justice, we must solve the above problems.This article is a case analysis of the master's thesis, the author mainly from the following three aspects to elaborate.The first part is the introduction of the case, the author according to the prosecution and the defense around the case evidence and their conviction views summarized the three focuses of controversy in this case, respectively is whether the case should be regarded as the crime of theft; whether the case should be identified as embezzlement;in this case should found to be innocent.The second part of this paper is the legal application and case analysis. In this part,the author first described whether the case should be identified as the crime of theft,secondly discusses whether the case should be identified as the crime of embezzlement,and finally to the case of a comprehensive analysis.Thoughts and suggestions on the case is the third part of this paper; this part and analysis, the author summarizes the following problems: first, the defendant shall be considered as not guilty; secondly, in the civil and criminal cross the controversial cases involving, in the conviction can according to the presumption of innocence to deal with;in sentencing should be according to the light guilt or innocence to deal with.
