Our Constitution defined the basic rights and duties of citizens,the suspects in the investigation authorities conducted the investigation and evidence collection stage,in Defendants' Right status they need legal protection,but in the criminal stage of the proceedings,because the investigating authorities suspect criminals lack of awareness of human rights protection,prone to violence,law enforcement event,infringes on the legal rights of criminal suspects,and thus the rights of suspects to judicial protection,the practical implementation of the legal equality of all elements of great significance.Firstly,the need to protect the rights of the suspect was the reason for the discussion and that both investigative functions and rights of the suspect is important.Secondly,from a theoretical and practical aspects in-depth analysis of the investigating authorities in the protection of the rights of criminal suspects a problem.And from procuratorial supervision defect investigation program is controlled by the investigating authorities themselves monopoly rights attorneys restricted investigative procedure by the investigating authorities control their own monopoly analyzes the causes.Finally,this paper to protect the suspect's rights,as well as investigating authorities in some conflict investigation stage were thinking,and perfecting the illegal evidence exclusion rules,improve the professional quality of public security,the judiciary,improve the criminal technical capability,advance reconciliation,justice court finds perspectives put forward relevant proposals.We hope this study can provide some reference for the investigation stage of criminal suspects rights protection.
