Problems And Legal Regulations In Micro-business Development Of China

In recent years, the Micro-business of China is blooming. It mainly relies on the platform of WeChat and benefits from the rapid development of mobile Internet. Micro-business is the product of "Internet+" and economic innovation. It opens up a new marketing mode, brings a lot of employment opportunities, and also promotes the development of the entire social economy. June 2015, China Electronic Commerce Research Center released "2014-2015 China Annual E-Commerce Law Reports", in which the "Top Ten typical legal case in the field of electronic commerce " was issued. Among the top ten cases is the first criminal case of someone using WeChat platform to sell fake products in Zhejiang province. Research on Micro-business has a certain theoretical and practical significance. Currently, there is no authoritative definition of Micro-business, and its legal status is not clear. Absence of regulation is the root cause of development disorder in Mico-business. It has been criticized for two main reasons, first is the deceptive advertising encroaching on consumers'rights, second is that parts of its marketing model are similar with pyramid sales. To solve these issues, one measure is to put Micro-business into the " Law of the PRC on the Protection of Consumer Rights and Interests " and another is to distinguish Micro-business from pyramid sales. Another issue to mention is E-commerce tax. The tax problem has been widely concerned, and has a lot of difficulties. There is no doubt that our government is to levy tax on Micro-business, but how to levy tax should be discussed. To the benefits in developing Micro-business, multi-pronged approaches should be adopted. We should build a third-party trading platform and a sound credit evaluation system, combining legal norms, government regulation and self-discipline together. Creating a well market environment to encourage and guide Micro-business to develop healthyly and orderly, in order to provide useful reference value to improve and strengthen the relevant laws and the correlation supervision.
