Study On The Relief Mechanism Of Road Traffic Accident Victims In China

In recent years,with the rapid development of China's economy,the number of road traffic accidents is rising rapidly as the number of motor vehicles is increasing,which causing huge casualties and property losses.After the occurrence of road traffic accidents,each of the victims and their families want to get a quick,fair and reasonable compensation.However,due to our country traffic accident victims relief mechanism is not perfect(such as motor vehicle compulsory insurance system has vulnerabilities,the social relief fund system has not been fully implemented,medical insurance does not guarantee the traffic accident medical expenses);dispute settlement mechanism is still not perfect(such as the people's mediation system)?The victim has to go through a series of tedious and lengthy process,it is possible to get part of the compensation or compensation.Even because the compensation is not in time to delay the treatment time,making the condition worse or even death.Countries (regions) all over the world attach great importance to the issue of road traffic accident victims relief,some countries (regions) have also developed a special law.In this paper,the author analyzes the handling mechanism of traffic accident damage compensation in China's mainland,in aboard and in Taiwan area,on the base of the empirical analysis,and deeply analyzes the existing problems in the treatment mode of traffic accident damage compensation in China.Then the author propose some ideas about how to improve and perfect the traffic accident compensation mode in China.This paper mainly divides into four parts,the first part: the paper analyses the trial situation of this kind of case on the base of our country traffic accident damage compensation case and data statistics.In the second part,the paper introduces the mechanism of traffic accident damage compensation in several typical foreign countries and Taiwan.The third part:it put forward the shortage of currently treatment mode of our country traffic accident damage compensation through the introduction of our country current traffic accident damage compensation dispute processing mode.The fourth part: Some suggestions are put forward to improve the victim relief mechanism of road traffic accident in our country.
