As one of the normal phenomenon of human being history, suicide has its sophisticated and constantly debatable theories to such an extent that the assistance behavior of suicidal abstracts increasingly argument. There are many legislation on the suicide assistance behavior abroad whereas related clause absent in domestic yet. That's why some relevant punishment cannot march legal principles and people's anticipation. What' s worse, the propaganda and assistance of suicide has become more and more frequently. Thus we must tackle this issue in a comprehensive way with multidisciplinary knowledge.On the basis of deepened theoretical research, the literature analysis method, comparison of the legislation and interdisciplinary theoretical research method should be adopted. There are three parts on this issue:Firstly, by the definition we clarified the nature of the aiding and abetting suicide is endangered other people's life and mutually social intercourse interest, but also exceeded the boundaries of legal, social and ethics rational. Therefore this part deepened the study of legislative exposition and feasibility. With the concrete analysis of the modifying constitutive elements and its complicity form, the second part is to dress some intricate problems, like the motivation mistake, the identification of the criminal launched or accomplished, etc. Besides that, this part offered the theoretical and feasible pedestal for relevant legislation in the future. With the condition given and comparison of legislation or relevant clause in and abroad, there has been advanced the rational regulation onto assistance of suicidal in the last part. Besides, this part has propelled realistic proposal about conviction plot as well as sentencing.
