This thesis determines the definition and introduces the main types of the unincorporated social organizations.By introducing the development histories of both China and other countries' unincorporated social organizations,we find out that these organizations are increasing progressively and more and more important.In view of this current situation,we introspect the exist law of China about the unincorporated social organizations which refuses to admit they're legal and should be one kind of civil law's social subject.Then this thesis introduces the unincorporated social organizations' evolution histories in the civil law system and the euramerian law system and these countries' exist laws about it.Trying to find out the real backward reasons which pushed the changing of the laws,then combining the China's current situation,try to learning and taking example by these advanced laws abroad.According to these countries' laws, the unincorporated social organizations should be treated as one kind of civil law's social subjects is not only an inexorable trend but also fit the theory about the civil law's social subjects.By analysing theevolution history of the theory of the civil law's social subjects,we find out the legal standard and the factual standard to distinguish a civil law's social subjects.After that,we demonstrate the theory basis and factual basis of treating the unincorporated social organizations as one kind of civil law's social subjects.Finally,we try to structure the concrete content of the unincorporated social organizations to solve all kinds of practical problems.
