Conditional non prosecution system, also known as the suspension of the prosecution system, which is a very important litigation system in our country. The system of junior high school is in order to effectively improve the efficiency and the quality of litigation, in order to effectively meet the needs of criminal policy settings. It can be said that the non prosecution system is the need of social development and judicial progress in China, and it is in line with our current judicial needs. At present, the market economy of our country is constantly improving and deepening, which is followed by the continuous reform and transformation in other fields. Under this background, the problem of social crime in our country is increasing to a certain extent. Some cases of the low level of crime, only a little bit to deal with effectively, if too much to take up the conventional judicial resources, will undoubtedly not conducive to the settlement of the case, but also to our judicial departments to bring great pressure. In addition, the problem of juvenile crime is becoming more and more serious in many crimes. Minors are the important power of the future development of our country, and provide a healthy growth environment, so that it can be healthy growth will have a vital role in our country's development. In this case, the conditional non prosecution system came into being.The conditional non prosecution system application, to help the judicial departments to better handle the plot slight but also don't accord with the immunity from prosecution of criminal cases, can greatly improve the crime processing efficiency, but also enhance the social effect. However, along with the increasing of our country's judicial cases, there are some problems in the application of the non prosecution system, how to improve the conditional non prosecution system in the new development situation.In this paper, we make a further study on the non prosecution system of conditional non prosecution. First of all, the concept and origin, characteristics, theoretical basis and value of the non prosecution system are summarized, which lay a good foundation for the following research. At the same time, through the investigation and analysis of the relevant provisions of the United Kingdom, the United Kingdom, the United States, Germany, Japan and other countries, it points out the differences and the causes of the relevant state conditional non prosecution. In this paper, the applicable situation and problems of the conditional non prosecution in our country are discussed, and the corresponding countermeasures are put forward.
